What is Legal Deposit?


Victoria’s Copyright Act of 1968 and the Libraries Act of 1988 direct publishers to deliver a copy of each new work within two months of publication to the State Library of Victoria (SLV). However, the requirement started much earlier withVictoria’s original Copyright Act of 1869. The term ‘work’ includes a wide range of ephemera including newspapers, news-sheets and newsletters. A work is deemed to have been published if reproductions of it are made available (whether by sale or otherwise) to the public. This definition encompasses all CNAV member publications.


Why should I comply with Legal deposit?


Newspapers have been described as ‘time capsules’ and your community newspaper contributes to building a history of Victoria. The news, events, opinions and obituaries carried in local papers document occurrences that are seldom recorded in history books or the daily newspapers. The State Library of Victoria catalogues all publications received under legal deposit and makes them available to the public. These archives become a treasure trove for amateur and professional historians, research students and genealogists. For instance, gems such as the Evelyn Observer of 1888 and the Lilydale Express of 1905 are available on microfilm in the SLV’s newspaper room.


What happens if I fail to comply?


The Act allows for fines to be imposed, but you are more likely to receive a reminder from the SLV with a request for copies of the missing issues to be sent to them. More importantly the library archive will be incomplete and future generations will not be able to refer to the local news and information carried in your newspaper.

Get into a routine of posting to the SLV one copy of each issue as soon as it is delivered from the printer. The address is:
